1. Acceptance
These Terms of Service ("Terms") govern your access to and use of Stack Freelance ("Stack Freelance", "we", "us") and its website, tools, templates, content and services (the "Service"). By using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old and legally able to enter into a contract to use the Service. If you use the Service on behalf of a business, you represent that you are authorised to bind that business.
3. Accounts
Some features require an account. You agree to provide accurate information, keep your credentials secure, and accept responsibility for activity under your account. Notify us promptly at support@stackfreelance.com if you suspect unauthorised access. Authentication is provided by Clerk.
4. Plans and subscriptions
We may offer a free tier and paid plans. Paid plans may be monthly or annual and renew automatically until cancelled. Plan features, limits and prices are described on the relevant plan or checkout page and may change on renewal. You can cancel at any time; access continues until the end of the current billing period unless stated otherwise.
5. Payments and taxes
Payments are processed by Stripe, PayPal or Razorpay. You authorise us and our processors to charge your chosen payment method. Prices are shown in the currency displayed at checkout and may exclude applicable taxes, including GST in India, which may be added at checkout. You are responsible for any taxes, duties or bank fees associated with your purchase.
6. Refunds and cancellation
Paid plans include a 30-day money-back guarantee unless the product page states otherwise. To request a refund, email support@stackfreelance.com within 30 days of your first payment. Refunds are issued to the original payment method. Digital templates may be refunded within 30 days if they have not been substantially used or downloaded, except where applicable law provides otherwise. Nothing in these Terms limits any statutory rights you have.
7. Templates and digital products
When you purchase or download a template or other digital product, we grant you a non-exclusive, non-transferable licence to use it for your own freelance or business purposes. You may not resell, redistribute, sublicense, share publicly or claim authorship of the templates, and you may not use them to build a competing template library. Third-party assets included in a template remain subject to their own licences.
8. AI-assisted tools
Some tools use third-party AI models. Outputs may be inaccurate, incomplete or unsuitable for your situation, and you are responsible for reviewing and verifying anything you use. Do not submit confidential, sensitive or personal data about others to AI-assisted tools. AI outputs are not legal, tax, financial or other professional advice.
9. Acceptable use
You agree not to:
- use the Service unlawfully, fraudulently or to infringe the rights of others;
- attempt to access accounts, systems or data you are not authorised to access;
- scrape, crawl or extract data at scale, or bypass rate limits or security measures;
- reverse engineer, copy or resell the Service except as permitted by law;
- upload malware or use the Service to send spam or abusive content; or
- use the Service in a way that could damage or overload our infrastructure.
10. Intellectual property
The Service, including our software, design, text, tools and branding, is owned by us or our licensors and protected by intellectual-property laws. You retain ownership of content you submit; you grant us a limited licence to host, process and display it to provide the Service. Our name and logos may not be used without permission.
11. Third-party links and affiliates
The Service may contain links to third-party websites, including affiliate links. We do not control and are not responsible for third-party content, products or practices. See our Affiliate Disclosure.
12. Disclaimers
The Service is provided "as is" and "as available". Our tools — including rate, invoice, tax and late-payment calculators — produce estimates for informational purposes only. They are not a substitute for professional legal, tax, accounting or financial advice. Tax rules and rates change; always verify figures with a qualified professional or the relevant authority. We do not warrant that the Service will be uninterrupted, error-free or that outputs will be accurate for your circumstances.
13. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business opportunities, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the event giving rise to the claim (or ₹1,000 if you have not paid us). Nothing in these Terms excludes liability that cannot be excluded by law.
14. Indemnity
You agree to indemnify and hold us harmless from claims, losses and expenses arising from your breach of these Terms, your misuse of the Service, or content you submit.
15. Termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, if required by law, or to protect the Service or other users. Provisions that by their nature should survive termination will continue to apply.
16. Governing law and disputes
These Terms are governed by the laws of India. Subject to any mandatory consumer protections, the courts of India will have exclusive jurisdiction over disputes arising from these Terms or the Service. Before starting formal proceedings, please contact us so we can try to resolve the issue.
17. Changes
We may update these Terms from time to time. We will post the revised version with a new "last updated" date. Continued use of the Service after changes take effect means you accept the revised Terms.
